1. Acceptance of Terms
By accessing or using the ToursTrust platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
These terms apply to all users of the Service, including agency administrators, salesmen, and any other authorized users.
2. Description of Service
ToursTrust is a management platform designed for travel agencies in the Galapagos Islands. The Service provides tools for managing vouchers, tourist information, tour bookings, accounting, operator payments, and related business operations.
The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. User Accounts
You must register for an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Agency accounts require verification of business documents before full access is granted. You agree to provide accurate and complete information during registration.
You must notify us immediately of any unauthorized use of your account or any other breach of security.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to store or transmit any content that is illegal, harmful, or violates the rights of others.
You are responsible for the accuracy of all data you enter into the platform, including tourist information, pricing, and payment records.
You may not attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems connected to the Service.
5. Data Ownership
You retain ownership of all data you enter into the platform. ToursTrust does not claim ownership of your business data, tourist records, or financial information.
By using the Service, you grant ToursTrust a limited license to store, process, and display your data as necessary to provide the Service.
You may export or delete your data at any time, subject to any legal retention requirements.
6. Payment and Billing
Certain features of the Service may require a paid subscription. Pricing and payment terms will be communicated before any charges are applied.
All fees are non-refundable except as required by applicable law or as explicitly stated in a separate agreement.
7. Limitation of Liability
To the maximum extent permitted by law, ToursTrust shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.
ToursTrust is not responsible for any financial losses resulting from data entry errors, system downtime, or third-party service interruptions.
Our total liability for any claims arising from the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
8. Intellectual Property
The ToursTrust platform, including its design, code, logos, and documentation, is the intellectual property of ToursTrust and is protected by applicable intellectual property laws.
You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
9. Termination
We may terminate or suspend your account at any time for violation of these Terms, with or without notice.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.
Data retention after termination will be handled in accordance with our Privacy Policy.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ecuador.
Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through the courts of Ecuador.
11. Changes to Terms
We reserve the right to update these Terms at any time. We will notify users of significant changes via the platform or email.
Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
